On June 13, 2025, the Wyoming Education Association (WEA) filed a lawsuit challenging the constitutionality of the ESA program. Following the Wyoming Supreme Court’s denial of the request to stay a Laramie County District Court injunction on October 7, 2025, the program remains temporarily blocked. Updates will be provided as available.

The Wyoming Steamboat Legacy Scholarship Act provides eligible Wyoming students a state-funded Education Savings Account (ESA) to cover approved educational expenses, including tuition, tutoring, educational therapies, and more. The program allows parents to choose the best educational pathways for their children.

Who is eligible for this program?

To be eligible for the Wyoming Steamboat Legacy Scholarship Account in the 2025–2026 school year, students must:

  • Be Wyoming residents aged 4 years and in pre-kindergarten through grade 12
  • Not be enrolled in a public school for the 2025–2026 school year
  • For Pre-Kindergarten Students: Families must have a household income at or below 250% of the federal poverty guidelines (FPL) (approximately $80,375 for a family of four)

How can families use the funds?

The Steamboat Legacy Scholarship funds cover a variety of approved educational expenses, including:

  • Tuition and fees at participating private schools
  • Tutoring services
  • Textbooks, curriculum and educational technology
  • Fees for summer education programs and after-school education
  • Educational therapies such as behavioral or speech-language therapy
  • Costs for college admission tests and Advanced Placement (AP) exams
  • Transportation costs to education service providers (for a fee)

What are the program rules and requirements?

  • Residency: Applicants must be residents of Wyoming.
  • Educational Status: Students entering K-12 grades who are eligible for the current school year.
  • Public School Status: While receiving an ESA, participating students cannot be enrolled in any classes in a public school. However, families can use ESA funds for fee-based services from participating public school districts. Be sure to check with your school on the fee-based services they offer.
  • Assessment Requirements: Parents must ensure their children receive instruction in core subjects and participate in academic assessments, either through the state assessment or a nationally norm-referenced assessment, to measure academic progress.

How do families apply?

  1. Check Eligibility: Ensure your child meets the eligibility requirements for the current school year by checking the Education Savings Account page of the Wyoming Department of Education site.
  2. Choose an Eligible School or Provider: Ensure your selected private school or education service provider is approved to receive Wyoming Steamboat Legacy Scholarship funds. You will need to apply separately to your choice of private school to ensure your child is accepted.
  3. Gather Documentation: Collect required documents, including proof of residency, child’s birth certificate, and for pre-kindergarten applications, financial records to validate income eligibility.
  4. Complete the Application: Follow the application process on the Education Savings Account page during the open enrollment period. Applications are on a first-come first-serves priority.
  5. Submit: Review and submit the application along with any necessary documentation.
  6. Upon approval, follow the provided instructions to set up your ESA account and begin allocating funds towards eligible educational expenses.
